Terms of Service

1. Acceptance of Terms

By creating an account or using Feinly ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms are governed by the laws of India.

2. Description of Service

Feinly is a SaaS order management platform for home bakers. It provides tools to receive customer orders, manage order status, and communicate with customers via WhatsApp. The Service is provided by Feinly ("we", "our", "us"), reachable at support@feinly.app.

3. Accounts and Registration

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One account per person. You may not create accounts on behalf of others without their consent.

4. Free Trial and Subscriptions

New accounts receive a 30-day free Pro trial. No payment method is required to start the trial. After the trial ends, your account moves to the Free tier unless you subscribe to a paid plan.

Paid plans are billed monthly or annually as selected. Payments are processed by Razorpay. By subscribing, you authorise us to charge your selected payment method on a recurring basis.

Subscription details, cancellation, and refund terms are governed by our Refund Policy.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that is fraudulent, misleading, or violates any third-party rights
  • Attempt to gain unauthorised access to other users' data
  • Use the Service to send unsolicited commercial messages in bulk
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service

6. Customer Data

When customers place orders through your public order form, you are responsible for how you use their personal data. You must comply with applicable data protection laws, including India's Digital Personal Data Protection Act, 2023. Do not use customer data for purposes other than fulfilling their orders without obtaining proper consent.

7. Intellectual Property

Feinly and its content are owned by us. You retain ownership of all content you upload (photos, order data, etc.). By uploading content, you grant us a limited licence to store and display it as part of the Service.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, upgrades, or suspend the Service without prior notice in urgent situations. We are not liable for any loss caused by service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Feinly is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to loss of revenue, data, or business. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Account Termination

You may delete your account at any time from Settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you by email for material changes. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
